The Supreme Court is going to hear a case that will determine if a corporation can legally lie in their advertising. Nike is arguing that it can lie about it's workers in their Asian sweatshops and that is under their First Amendment rights. That is more obscene than any type of porn.
The justices agreed to hear a Nike appeal of a California Supreme Court ruling that Nike's statements about its labor practices were commercial speech that did not deserve full First Amendment protection under the U.S. Constitution.
The important free-speech case stemmed from a 1998 civil lawsuit filed in California claiming that Nike willfully misled the public about working conditions for the Vietnamese, Chinese and Indonesian laborers who produce its footwear.

My point is that there are more type of Obsenity than just sexual. How alot of the people in those factories and what Nike does to the countries would be obscene.
This argument isn't as simple as people think though. On the one hand I think it sucks ass that Nike makes its shoes overseas instead of here because it puts Americans out of work. On the other hand the unions in this country are totally OUT OF CONTROL! That is why companies are moving thier labor overseas to a large degree. It isnt the only reason but when an un-skilled laborer in Idaho who belongs to a union wants to be paid 12.00$ per hour to do a repetative mindless job all day it will raise some eyebrows at the corporate level. In that article it also states that the workers in southeast Asia cant make a living wage and are beaten regularly. If I were beaten regularly at work I would quit. If I couldn't make a "living wage" I would quit.
In the case of CHINA this is true and many employees are literally SLAVES! The government takes people from thier homes and makes them work at toy factories because of thier nationalized economy and Marxist/communist/dictatorship governments they have no choice. They can either work there and make basicly nothing or they can be put into political prison. This is not the norm in asia as we know. Most Asian countries welcome American businesses and the meager wages (by our standards) that are given unto them. In Thailand you will not find a slave labor run business anywhere. What you will find is HUGE lines when an American factory opens.Why is this? Because American companies pay better on the whole than thier Asian counterparts. the point though is that American businesses do frequently conduct operations in countries that use slave labor. All that I'm saying is that NIKE is not one of those companies. The P.R. nightmare that they would have to deal with would be a more than thier spin machine could deal with.
The big culprits seem to be toy companies and video game companies. Still it angers me just a tad. We have to remember that these companies are in business to make a profit and NOONE mentions companies like Nintendo who have worse business practices than Microsoft and routinely manipulated the market and gouged the living hell out of consumers when they had 89% of the gaming industy under thier thumb. Did you know that microsoft uses prison labor to make packaging for thier windows products? That does not mean they are evil though. Work programs in prison are voluntary. Still something to think about though.
